17. Dispute Resolution and Binding Arbitration

Before filing any claim, you agree to first contact Peremis at info@peremis.com and attempt to resolve the dispute informally. You and Peremis agree to make a good-faith effort to resolve any dispute within 30 days before starting arbitration or other proceedings.

Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, any purchase, any product, or any interaction with Peremis will be resolved exclusively by final and binding arbitration, not in court.

The arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, which the AAA publishes for consumer disputes. The arbitration will be conducted before a single arbitrator, in English, and on an individual basis only. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Nothing in this section prevents either party from bringing an eligible individual claim in small claims court, so long as the matter remains individual and nonrepresentative.

18. Waiver of Jury Trial

To the fullest extent permitted by law, you and Peremis knowingly and voluntarily waive any right to a trial by jury in any action, proceeding, or counterclaim arising out of or relating to these Terms, the Site, any purchase, or any interaction with Peremis.

19. Class Action Waiver

To the fullest extent permitted by law, you and Peremis agree that any dispute will be brought only in an individual capacity and not as a plaintiff or class member in any purported class action, consolidated action, representative action, collective action, mass action, or private attorney general action.

Unless both parties agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

20. Governing Law and Venue

These Terms, your use of the Site, and any dispute between you and Peremis will be governed by the laws of the State of Texas, without regard to conflict of law principles.

If any claim is found not subject to arbitration, or if arbitration is held unenforceable as to a particular claim, then that claim must be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction and venue of those courts.

21. Time Limit to Bring Claims

To the fullest extent permitted by law, any claim or cause of action arising out of or relating to the Site, any purchase, any product, or these Terms must be brought within one year after the claim arises, or it is permanently barred.
